Terms and Conditions for ‘career coaching until you reach your goal’ package.

1. Introduction

These Terms and Conditions govern the provision of the career coaching incentive (the “Incentive”) offered as part of the Career Accelerator Programme (the “Programme”) operated by FourthRev (“we”, “us”, “our”). By participating in the Incentive, you (“Learner”, “you”) agree to be bound by these Terms and Conditions.

2. Description of the Incentive

The Incentive provides Learners with ongoing career coaching until they reach their career goal as defined within the parameters of these Terms and Conditions. The Incentive is designed to support Learners in achieving a specific, predefined career objective.

3. Eligibility Criteria

To be eligible for the Incentive, Learners must: Be actively enrolled in the Programme as a paying Learner. Be in good standing with the Programme’s progression requirements. Agree on a realistic and achievable career goal with their coach as per the guidelines outlined in the “Setting a Career Goal” section. Commit to taking agreed actions as detailed in the “Actions” section.

4. Fair Usage Policy

The purpose of the Incentive is to provide targeted, effective career coaching to assist Learners in reaching a pre-defined and agreed career goal. To ensure fairness and prevent abuse, the following fair usage policy applies: Duration of Coaching: coaching under this Incentive will be available for a maximum of 12 months from the start date of Career Accelerator. Frequency of Sessions: Learners are entitled to no more than two coaching sessions per month unless otherwise recommended by and agreed upon with their coach, and as long as they are fulfilling the other criteria such as taking the actions in the preceding session. Scope of Coaching: Coaching sessions will focus solely on career development and job acquisition skills. Sessions are not to be used for other purposes such as personal therapy or unrelated training. Career Goal Definition: Career goals must be defined in measurable terms (e.g., obtaining a job in a specified industry or achieving a specific job title) and agreed upon by both the Learner and the coach within the first month of coaching.

5. Setting a Career Goal

You and your coach will agree on a career goal and key milestones with specific target dates to track progress. These goals and milestones will be recorded in the Career Coaching Tracker. The coach will ensure that the goals are realistic and achievable within a reasonable time frame.

6. Actions

The success of the coaching process is contingent upon the Learner’s commitment to taking actionable steps between sessions. After each coaching session, the Learner will be assigned actionable tasks, and a mutually agreed-upon timeframe for completion will be established. If the agreed upon time frame to take actions changes, the learner agrees to keep the coach updated on the new timeframes so the coach can review that the goal is still achievable.

7. Modification of Career Goals

Career goals may be re-evaluated and modified upon mutual agreement between the Learner and the career coach, taking into consideration changes in the job market and the Participant’s professional development. Such modifications are limited to one change per six-month period.

8. Termination of Participation

Participation in the Incentive may be terminated under the following conditions: Achievement of Career Goal: Once the agreed-upon career goal is achieved, the Learner’s eligibility for further coaching under this Incentive ends. The Learner stops actively working towards reaching their career goal while on the Career Accelerator. If the learner stops taking the agreed actions, the learner will revert to having six sessions, which will be available for up to three months after the completion of the CA. Non-compliance with Programme or Incentive Terms: Non-compliance with any terms of the Programme or these Terms and Conditions may result in immediate termination of participation in the Incentive. Voluntary Withdrawal: Learners may withdraw from the Incentive at any time. However, re-enrollment will be subject to review and may not be guaranteed. Repeat cancellations: More than two cancellations in a row will result in termination of participation in the incentive, and the learner will revert to having six sessions available for up to three months after completing the CA. If the learner does not keep the coach updated on the new timescales, then the learner may be withdrawn from the Outcomes-based Coaching and will be reverted to 6 sessions from that point on. If the learner withdraws from the programme, the incentive will be terminated. If the learner pauses their progression in the programme, the incentive will be suspended until the learner rejoins the programme, at which point the career goal will be reviewed, and the dates will be revised. If the learner falls behind in their payments the incentive will be paused until the payments are up to date. If this impacts the achievement of the Career Goal then the coach and the learner will revise the outcome to one that is achievable within the new time frame.

9. Events Outside Our Control

When external factors beyond the Learner’s or Coach’s control significantly limit opportunities, the extended coaching will be subject to reevaluation to ensure alignment with the Learner’s circumstances and available opportunities.

10. General Conditions

We reserve the right to modify these Terms and Conditions at any time. Such modifications will be effective immediately upon posting of the modified terms. Your continued participation in the Incentive constitutes acceptance of these terms and conditions as modified.

11. Resolutions of disputes between the learner and the coach.

In the event of a difference in opinion between learner and Career Coach about whether the conditions are being met, the Career Coaching Community Manager will review and take the final decision.

12. Limitation of Liability

We will not be liable for any loss or damage arising from your participation in the Incentive, to the fullest extent permissible by law.

13. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Kingdom, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of the United Kingdom.
