Version dated: 09 September 2021
Who we are:
We are FourthRev Ltd (FourthRev, we, us or our), a company registered in England and Wales under company number 12333799. Our registered office is at Harwood House, 43 Harwood Road, London, England, SW6 4QP.
These Terms and Conditions:
These Programme Terms and Conditions for Students (Terms) set out the terms and conditions that govern your use of FourthRev products and services (the Services), including how you can register for any programme offered by FourthRev (a Programme).
Please read these Terms carefully. By using the Services or registering for a Programme, you agree to be bound by these Terms. If you do not agree with these Terms then you must not register for a Programme or use any of our Services.
Agreeing to the Policies:
By agreeing to these Terms, you also agree to the following policies (the Policies) which are incorporated by reference into these Terms:
Specific terms and conditions for a Programme:
FourthRev delivers programmes in collaboration with a partner educational institute (an Education Partner). Please note that each Programme may have its own terms and conditions which you must also read and understand. Where there is a conflict between these Terms and specific Programme terms and conditions, the Programme terms and conditions will prevail.
Revisions of these Terms:
We reserve the right to vary these Terms at any time. Any updated Terms will be displayed on the Website and will take effect when the Terms are posted. By continuing to use the Services and being enrolled on a Programme following such changes, you agree to be bound by any variation made by us. It is your responsibility to check these Terms periodically to check for any updated Terms.
How to register for a Programme:
The details on how to register for a Programme vary and you should check the terms and conditions of a specific Programme to find out exactly how to register. Generally, you can apply for a Programme through an online application system which will contain an online application process. This process will assess the admissions requirements for the Programme. Please note that these are general entry requirements, and you must check with each specific Programme terms and conditions to see what other entry requirements are applicable.
You should also be aware that the Education Partner collaborating on a specific Programme has complete discretion to request that your registration for a Programme be denied. The Education Partner can also request that you are removed from a Programme, that your activity on a Programme is suspended, or that your certificate of completion of a Programme is withheld. If this occurs, the Education Partner will set out the reason for such matters, which shall relate to outstanding fees, misconduct on a Programme or any other lawful reason.
Is a Programme suitable for you?
It is your responsibility to ascertain whether the Programme you are registering for is suitable for you, based on your individual requirements. Key information in relation to the Programme is set out on the Website. Each Programme also has a ‘Programme Brochure’ which is circulated to all interested learners. The Programme Brochure contains all information in relation to a Programme. Please ensure that you request a copy of a Programme Brochure before you register for a Programme. If you have any questions regarding a Programme or your suitability, please contact us at email@example.com.
Information you will need to provide:
Providing accurate information:
Please be aware that all information you provide to us when you register for a Programme must be true, accurate and complete. If any of the details change, you must inform us immediately by contacting us at firstname.lastname@example.org.
Unauthorised use of your Programme account:
If you are aware that there has been unauthorised access to your account, you must contact us immediately. It is your responsibility to keep your security information safe. If you believe there has been unauthorised access to your account or you notice any unusual activity, please let us know as soon as possible by emailing email@example.com.
You must be over 16:
You cannot register for a Programme if you are under the age of 16. If you are aged between 16 – 18, you can only participate in a Programme with the written consent of your parent or legal guardian.
Only students who register for a Programme may participate in that Programme. You must not share your username or password with any other person or allow any other person to participate in the Programme on your behalf. You must also not impersonate any other person when communicating or dealing with us, or when accessing the FourthRev Platform. You are strictly forbidden from using another participant’s login credentials.
Accepting these Terms:
When you apply for a Programme, you will be asked to agree to these Terms. By clicking on “I accept” or any other similar wording indicating your acceptance of the Terms, you agree to be bound by these Terms and the Policies.
To successfully participate and complete a Programme, you must have a valid email address and access to a computer and internet. There will also be Programme-specific requirements that you will be informed of on the Website, in the Programme Brochure, in the relevant Programme/Course handbooks, or in conversations with a member of the FourthRev team. For your internet browser, we recommend that you use Google Chrome.
As this is an online-only programme, we require that all applicants confirm they have the required technology and internet access to fully participate in the Programme. This will be assessed via self-assessment in which we provide the learner a test environment in order to assess whether their tech setup will be compatible with the systems and tools used on a Programme. To complete the self-assessment, you must have access to a laptop or computer, and not just a tablet, mobile phone or similar smaller devices.
Some Programmes may require additional software or resources. If this is the case, you will be informed of this at the time of registration or at the commencement of the Programme. Please note that some applications, such as Google or YouTube, are used for the Programme delivery and these services may be blocked depending on your jurisdiction. Please contact us at firstname.lastname@example.org if you have any concerns about your ability to use any such services before you register for a Programme.
Many Programme modules use videos to deliver tutorials and lectures, which are often compulsory. If your internet connection is slow, please be aware that attempts to view these videos may be difficult.
Variations to Programme Requirements:
We may change the requirements for a Programme at our sole discretion at any time. We will contact you in advance if any requirements change.
You may be required to source and obtain access to necessary software and resources required for any Programme at your own cost. FourthRev does not accept any liability for your inability to obtain such software and resources nor do we accept any liability for any consequences of your use of the software or resources.
We are not affiliated with any companies responsible for providing software and resources on a Programme unless expressly stated otherwise.
FourthRev’s right to cancel a Programme:
If we find that there is insufficient demand for a Programme, we may choose to cancel that Programme at our sole discretion. If we do so, and you are already registered for that Programme, we will contact you immediately and process any refunds in accordance with our refund policy below.
Once you have successfully registered for a Programme, you will receive confirmation of your enrolment. Confirmation of your enrolment occurs once payment is received, or a specific payment plan has been agreed to.
Collaboration with Education Partners:
FourthRev designs and develops Programmes in collaboration with reputable Education Partners. Each Programme is approved by such Education Partner, the details of which are clearly displayed on any Programme description. Unless otherwise stipulated, the Programmes are not accredited by that Education Partner. Nothing in these Terms establishes a relationship between you and an Education Partner, or entitles you to use the resources of that Education Partner beyond participation in the Programme , unless expressly stated otherwise in specific Programme Terms and Conditions.
FourthRev delivers the Programmes:
A Programme will be delivered and administered by FourthRev on the FourthRev platform.
The FourthRev Platform:
Upon acceptance and enrolment onto the Programme you will be granted access to the Fourthrev Platform. We will create your account and profile based on your successful enrolment (or, if you already have a profile then we will use your existing profile for the new Programme onto which you are enroled). FourthRev reserves the right to suspend or terminate your access to the platform due to non-payment of fees or failing to comply with any of our policies or guidelines (or any other valid reason that we or an Education Partner provides). Please note there may be some delays between enrolment and access to the platform.
Following completion of the Programme, you will retain access to the Fourthrev platform and learning materials contained within for a period of six months. After six months your access will be revoked.
Subject to these Terms, and to you paying the relevant fees for a Programme, FourthRev grants you a limited, personal, non-exclusive, non-transferable, royalty-free and revocable license to use the Services, including all services associated with our Programmes, and the FourthRev Platform.
All Programmes will be delivered in English, including any instructions and administration for such Programme. Any submissions by participants on a Programme, including coursework, must be in English.
How we may contact you:
Certain Programmes may require you to use external websites. We accept no liability whatsoever in relation to any links to other websites and we are not responsible for technical support in relation to those websites.
Programme content provided “as is”:
To the extent permissible under applicable laws, all Services, Programmes, Courses and any content are provided “as is” without representations or warranties of any kind, whether express or implied, in respect thereof, and in particular, we make no representations or warranties regarding the quality of the Programme content or the fitness of the Programme content for the purpose for which you acquired it.
All Programme assessments will be detailed in the Programme Brochure and given in full detail after you have enroled on a Programme.
Retakes of Programme assessments:
Retake policies will be outlined upon commencement of a Programme
Certificate of Completion:
Each Programme is conducted in collaboration with an Education Partner, such as a university. After successful completion of a Programme, you will be issued a Certificate of Completion by the relevant Education Partner. Other levels of certification may be issued by an Education Partner based on the Programme. If you have any questions about Programme completion, please email email@example.com.
Once you have successfully registered for a Programme, you will be assigned a Success Manager, who will be in regular contact with you throughout the Programme. Your Success Manager will help to set goals and work with you when you are facing any issues with completing the Programme, accessing the Programme materials or sitting the Programme assessments.
Your Success Manager will also periodically engage with a career coach who will be focussed on working with you to understand and formulate your career aspirations as part of the Programme and beyond.
You may also be assigned a Career Coach, depending on which Programme you are enroled on, who is a specialist career expert focused on your job and career outcomes. You will meet regularly with your Career Coach throughout the Programme experience in order to ensure you are preparing yourself for career success within the Programme and beyond.
Under no circumstances may you do any of the following while participating in a Programme or accessing the FourthRev Platform:
Suspension or Removal from a Programme:
If we find that you have used the Website, the Services or the Programme in a prohibited way, or there is a dispute about your conduct in relation to the Services or the Programme, then we may, in our sole discretion, remove or suspend your participation in the Programme. If we remove you from a Programme because of your breach of these Terms, you will not be entitled to any refunds.
As a student on one of the Programmes, you are expected to act with integrity and conduct yourself in a way which brings the best version of yourself to a Programme. We are currently creating our official Student Code of Conduct which is being made to (i) maintain a safe environment, (b) create an inclusive and welcoming community, and (iii) create clear guidelines and boundaries for building relationships and navigating a Programme.
If you have any questions about the Student Code of Conduct please email firstname.lastname@example.org.
Under no circumstances may you plagiarise another person’s work. Plagiarism is using another person’s ideas or work and pretending that it is your own.
Consequences of Plagiarism:
Instances of plagiarism will be dealt with in line with the policy of the Education Partner of the Programme. Plagiarism is a serious offence and potential consequences of plagiarism could include voiding of assessment grading and removal from the Programme.
All fees for a Programme are set out clearly in the Programme description. On registering for a Programme, you agree to pay the relevant Programme fee (and any other fees that may arise from your participation on a Programme).
As part of registering for a Programme you will be invoiced for the full amount of your Programme fees and required to pay the invoice via bank-to-bank transfer within 30 days.
Other payment options:
If you have agreed to an alternative payment option or plan, this will be shared with you in writing and you agree to be bound by the terms of this agreement.
Payment of VAT and other Taxes:
Any VAT or other applicable taxes payable in addition to the Programme fees will be identified in your invoice or information pack and such amounts are your sole responsibility, unless the contrary is stated.
You acknowledge and agree that you will pay any extra administrative or bank charges that may apply to your payment of the fees, charges or additional costs, depending on your jurisdiction.
Suspension or removal for non-payment:
If you fail to pay all the applicable fees for a Programme by its due date for payment, FourthRev may, in its sole discretion, suspend or remove you from that Programme until full payment is received. If full payment is not made within any additional period of time, as notified by us to you, then we have the right to cancel your registration and remove you completely from the Programme. In this situation, you will not be entitled to any refund of any fees.
If there is a dispute about payment of any fees, FourthRev may, in our sole discretion, suspend your participation in the Programme for the period of such dispute.
Please be aware that if you have any outstanding payments in relation to a Programme, you will not be able to complete that Programme or receive a final result. We will also not be able to certify that you have completed that Programme, or issue any awards, until full payment is received.
If you wish to cancel your programme enrolment, you should request to do so in writing to your Success Manager who will review your request and may consult with you in reaching an informed decision before confirming your cancellation.
If you wish to defer your participation in a programme, you must request to do so in writing to your Success Manager, who may consult with you in reaching an informed decision. FourthRev will work with the education partner to negotiate a deferral pathway to ensure your best chance of success on the programme but the final decision will be at the discretion of the education partner.
If you are seeking to defer your participation in a programme to a future cohort then you will be required to resume your studies at the same point in the programme at which you left. Deferrals are limited to starting one calendar year from the date you agree to defer participation in the programme.
Should you take up the option of a programme deferral, you automatically waive your right to apply for a refund of any kind.
No liability for Programme results:
FourthRev shall not be liable for any costs, claims, damages, or loss that you may suffer as a result of: (i) registering for; and/or (ii) participating in any Programme which is not relevant, suitable or does not meet your requirements, and/or the requirements of any relevant industry or commercial body.
No guarantee for suitability:
FourthRev does not, under any circumstances, guarantee your suitability for a particular Programme.
No liability for failure to obtain employment:
FourthRev shall not be held liable, under any circumstances, for any costs, claims, damages or loss, if you are not able to obtain employment or a promotion after your completion of a Programme, or attain any other outcome you may believe completing a Programme will help you to achieve.
Limitation of liability:
If we breach these Terms or are negligent, we are liable to you for foreseeable loss or damage that you suffer as a result. By ‘foreseeable’ we mean that, at the time the contract was made, it was either clear that such loss or damage would occur or you and we both knew that it might reasonably occur, as a result of something we did (or failed to do). We are not liable to you for any loss or damage that was not foreseeable, any loss or damage not caused by our breach or negligence, or any business loss or damage. Nothing in these terms excludes or limits our liability for any death or personal injury caused by our negligence, liability for fraud or fraudulent misrepresentation, or any other liability that the law does not allow us to exclude or limit.
FourthRev’s intellectual property rights:
All of the intellectual property rights in the Services and a Programme, and in any text, images, video, audio or other multimedia content, software or other information or material submitted to or accessible from the Website, the Services and a Programme are owned by us and our licensors. We and our licensors reserve all our intellectual property rights (including, but not limited to, all copyright, trade marks, domain names, design rights, database rights, patents and all other intellectual property rights of any kind) whether registered or unregistered anywhere in the world. This means, for example, that we remain owners of them and are free to use them as we see fit. Nothing in these Terms gives you any legal rights in the Website or Programme content or the Services, other than as necessary for you to access it. You agree not to adjust, try to circumvent or delete any notices contained on the Website or the Content (including any intellectual property notices) and, in any digital rights or other security technology embedded or contained within the Website, a Programme or the Services.
Your intellectual property rights:
As part of a Programme, you may be able to share your own content. All intellectual property rights in that content remain with you, and you are responsible for it. When you upload your content, you grant FourthRev an irrevocable, perpetual licence (give us permission which you cannot withdraw) to use your content and share it with third parties, such as our Education Partner or prospective clients. We will always credit you as the author of the work.
Termination due to breach:
If you breach any part of these Terms and that breach remains unremedied for 5 days after receiving written notice from us, or is incapable of remedy, then we may in our sole discretion terminate your participation in a Programme. You will not be entitled to a refund in this case.
Termination due to modification:
FourthRev may add or remove functions, features, or requirements to a Programme, and we may suspend or stop our service altogether. We will provide you with advance written notice before we make any material changes to a Programme. You may also discontinue your use of our services and Programmes at any time, at which point a refund may apply in accordance with our refund policy above.
We want you to have the best possible experience on a Programme or using our Services. If you have any general complaints, please email us at email@example.com.
If you have any complaints about a Programme, please do direct them in the first instance to your Success Manager in whatever format you feel most comfortable with. Your Success Manager will then be able to take the complaint forward and work with you towards a response and suitable resolution.
If you do not feel comfortable discussing the complaint with your Success Manager then you can get in touch by email at firstname.lastname@example.org. This email will be picked up by a member of the FourthRev support team not connected to the Programme who will work with you towards a suitable resolution.
No transfer of rights:
You are not allowed to transfer your rights under these terms to anyone without our prior written consent. We may transfer our rights under these terms to another business without your consent, but we will notify you of the transfer and make sure that your rights are not adversely affected as a result.
If any provision of these terms (or part of any provision) is or becomes illegal, invalid or unenforceable, the legality, validity and enforceability of any other provision of these terms will not be affected.
If you breach these terms and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these terms.
Governing law and jurisdiction:
If you are a consumer based in the UK, the laws of England apply to these terms, although if you are resident elsewhere in the UK you will retain the benefit of any mandatory protections given to you by the laws of the region of the UK in which you live. Any disputes will be subject to the non-exclusive jurisdiction of the English courts. This means that you can choose whether to bring a claim in the courts of England or in the courts of the part of the UK in which you live. If you are a consumer based outside of the UK, please be aware that other relevant laws may apply to you. It is your duty to be aware of these relevant laws and how they apply to you.
